Apply LMIA – Labour Market Impact Assessment

LMIA stands for Labor Market Impact Assessment and is a document that helps employer to hire temporary foreign worker.

The positive LMIA confirms that there is need of foreign worker and no Canadians or permanent resident is available to fill the job.

There are jobs and certain conditions in which a foreign worker will be exempt from LMIA and may directly apply for work permit.

How to get LMIA

There are different types of programs to apply LMIA.

  • High wage LMIA
  • Low wage LMIA
  • Seasonal Agricultural Workers Program
  • Agricultural Stream

High Wage LMIA

The employers are required to provide documents to proof legitimacy of job offer and business. There might be need of transition plan depending on job category.

There must be recruitment efforts to hire Canadians or permanent resident before offering job to foreign worker. The advertisement of job must be posted on Job bank along with other 2 methods. The other 2 advertisement sources should be targeting appropriate experience, education or skill level.

The job must be remained posted for minimum 4 continuous weeks in last 3 months. The job posting should contain information required by ESDC. The proof of job posting is submitted along with the LMIA application which should include where, when and how long was the job posted.

To apply under this category, the job must be offering prevailing wage defined as median wage on job bank

Low Wage LMIA

When an employer is paying wage lower than the median wage on job bank for the job then the LMIA application is submitted under this program. The employer may require to pay fee of $1000 depending on the category of job. The employer will need to submit proof of job offer validity and authenticity of business.

In low wage LMIA, the employer is subject to cap on proportion of foreign workers. However, there are certain job categories exempted from cap. There must be recruitment efforts to hire Canadians and permanent residents. The job must be posted on job bank along with other 2 sources which should be targeting different underrepresented group: Indigenous persons, vulnerable youth, newcomers, and persons with disabilities.

Similar to high wage,  the job should remain posted for 4 consecutive weeks in last 3 months and proof of advertisement will be submitted with application.

Hire a skilled worker to support their permanent residency

This LMIA program allows employer to support permanent residency of temporary foreign worker when Canadians and permanent residence people are not available. This program is also called as dual intent LMIA.

The employer will pay the $1000 processing fee for each position to cover cost of processing of dual intent LMIA application. However, the employer is exempted from paying if the position is only supporting the permanent application and do not require to get work permit.

The offered position must be paying median wage or above to worker. This program also required to prove recruitment efforts before offering position to foreign workers.  However, the recruitment efforts depend on the wage offered, the Advertisement and Recruitment requirements of the Stream for Low-wage positions if wage is below provincial/territorial median hourly wage, and Advertisement and Recruitment requirements of the Stream for High-wage position if wage is above provincial/territorial median hourly wage.
